From Allies to Adversaries: Dutch Activists Force Government’s Hand on F-35s

by admin477351

A determined campaign by three Dutch activist groups has successfully forced the government’s hand on military exports to Israel, transforming them from policy advocates to legal adversaries in a case that has now reached the Supreme Court. The court is hearing the government’s appeal against a ban on F-35 parts shipments won by these organizations.

The lawsuit, filed in late 2023, represented a strategic shift for the human rights groups, taking their campaign from the streets and political lobbies into the courtroom. They built their case around the argument that the Netherlands was legally obliged to prevent its territory from being used to supply a conflict where war crimes were allegedly being committed.

Their legal strategy paid off spectacularly in February 2024. A Dutch appeals court accepted their arguments and ordered the government to cease the exports to Israel. This victory demonstrated the power of civil society to use the legal system to challenge and even halt government foreign policy in its tracks.

The government, forced onto the defensive, has consistently argued that these decisions belong in the political arena. Its appeal to the Supreme Court is an attempt to reclaim its authority from the judiciary and, by extension, from the activist groups that successfully used the courts to block its policy.

This case highlights the evolving role of civil society in holding governments accountable for their role in foreign conflicts. The final ruling will determine the extent to which legal activism can serve as a check on executive power in the Netherlands and potentially serve as a model for similar efforts elsewhere.
